Access to and use of this website provided by Kelly’s Sign and Print Shop you are deemed to have read and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: "Client", “You” and “Your” refers to you, the person accessing this website and accepting Kelly’s Sign and Print Shop terms and conditions. "The Company", “Ourselves”, “We” and "Us", refers to Kelly’s Sign and Print Shop. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing English Law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Use of this website constitutes your acceptance of these Terms and Conditions, which take effect on the date that you first use this website. Kelly’s Sign and Print Shop may modify any of the Terms and Conditions at any time and in its sole discretion by posting a new set of Terms and Conditions on our website. Your continued use of our site after such changes constitutes your acceptance of this agreement as modified in the posted changes.

Privacy Statement/Confidentiality

We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Kelly’s Sign and Print Shop reserves the right to store your profile information received via the registration process for internal and market research purposes. Kelly’s Sign and Print Shop may contact you from time to time by e-mail to share information that may be of interest to you. You may opt out from receiving such e-mails at any time.

We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by Kelly’s Sign and Print Shop will only be in connection with the provision of agreed services and products.

Exclusions and Limitations

Kelly’s Sign and Print Shop has made every effort to see that no inaccurate or misleading data, opinion or statement appear in this website, though we make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, availability, or validity of the data or information in our website, or in any other site to which it may be linked. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, Kelly’s Sign and Print Shop:

This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected. If any of these Terms and Conditions should be determined to be illegal, invalid, or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction which that Term or Condition is illegal, invalid, or unenforceable, it shall be severed and deleted from this clause and the remaining Terms and Conditions shall continue and remain in full effect, continuing to be binding.

Payment Terms

Cash, money orders or Personal Checks are the acceptable methods of payment. Terms are sent on an individual basis, may include COD, a percentage down, or on 30 day terms. All goods remain the property of Kelly’s Sign and Print Shop until paid for in full. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Returned checks will incur a $25 charge to cover banking fees and administrative costs. In an instance of a second Returned check, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Quotation/Estimates/Fees

Quotes/Estimates are good for 30 days from posted date, unless otherwise noted. Prices are subject to change thereafter. Kelly’s Sign and Print Shop works hard to keep our prices competitive. All quotes must be signed off on to start production.

Depending on the project specifications there may be additional fees incurred. These will be included in the estimate, and will not be hidden from the customer. Additional fees may include Design Fee, Installation Fee, or Layout Fee.

Proofs / Accuracy

Color accuracy of proofs are an approximate and cannot be guaranteed, because of differences in monitors, proofs are not printed on the same material as the final product so colors will vary depending on final material and production process, also proof colors are not calibrated or balanced. The first electronic proof is free and will be either emailed or shipped to customer. Production begins after approval of final proof. No verbal approvals, all approvals need to be in writing

Delivery/Shipping

Customer shipping and handling fees will be discussed, and included in quote if needed. Kelly’s Sign and Print Shop will ship nationwide with UPS.

Right to Subcontract

Kelly’s Sign and Print Shop reserves the right to subcontract or assign any portion of a job to another company if needed.

Cancellation Policy

Minimum 48 hours notice of cancellation required. Notification needs to be in person, via email, mobile phone ‘text message’ and/or fax, or any other means will be accepted subject to confirmation in writing. We reserve the right to charge for any material we purchased on your behalf to start production of said job. All sales are final once your job has gone to production, print, and is complete.

Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. Kelly’s Sign and Print Shop reserves the right to not produce subject matter we deem inappropriate. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, complete. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.

The customer represents that they have legal right to produce or reproduce all printed/vinyl materials ordered from Kelly’s Sign and Print Shop. In the event that a charge, claim, demand or proceeding is made against Kelly’s Sign and Print Shop based upon illegal and or wrongful acts by said customer, or that the product produced or printed at the request of customer infringes any copyright, patent, or other proprietary right of any person, or contains matter that is slanderous, defamatory or obscene. The customer shall indemnify and hold Kelly’s Sign and Print Shop harmless from and against any loss, damages, costs, and expenses arising from or related to the claim including without limitation: defending Kelly’s Sign and Print Shop against claim, paying any judgment or award against the customer, and reimbursing KKelly’s Sign and Print Shop for any legal fees and expenses incurred.

Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

General

If these Term and Conditions are not accepted in full, you do not have permission to access the contents of this website and therefore should cease using this website immediately. By requesting Kelly’s Sign and Print Shop to perform services and produce products for you, you are agreeing to our terms and conditions without modifications.

Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.
